Terms of Service

Last updated: October 17, 2026

These terms cover every package you buy from JoshtheDesigner (“I”, “me”), run by Josh at joshthedesigner.com. By checking the box at checkout and paying, you (“you”, “the client”) agree to them. If a signed proposal or statement of work exists for your project, it controls where it differs from these terms.

1. What you’re buying

Each package is described on the homepage at the time you buy it: Email Foundations, Email Program, Website Build and Care Plan. That description sets the scope. Work outside it is quoted separately before I start.

2. Payment

  • Email Foundations is paid in full up front.
  • Email Program is billed monthly in advance, with a 3-month minimum. After the minimum, it continues month to month until either of us cancels with 30 days’ written notice.
  • Website Build starts with a deposit that holds your slot in my schedule. The balance is due at launch, or split into up to 3 monthly payments if we agree that in writing before work starts.
  • Care Plan is billed monthly in advance and continues until either of us cancels with 30 days’ written notice.

Payments are processed by Stripe. Prices are in US dollars. Launch prices apply to purchases made while launch pricing is shown on the site, and stay in place for recurring packages for as long as that subscription stays active.

3. Late or failed payments

If a payment fails or is more than 7 days late, I pause work until it’s paid. Deadlines move by the length of the pause.

4. Cancellations and refunds

  • Website Build deposit: refundable in full until work starts. Once work has started, it is not refundable.
  • Email Foundations: refundable in full until kickoff. Once work has started, it is not refundable.
  • Email Program: months already billed are not refunded. Canceling inside the 3-month minimum means the remaining minimum months are still owed.
  • Care Plan: months already billed are not refunded.

5. What I need from you

Timely access to your platforms (Klaviyo, Shopify, WordPress or similar), brand assets, and feedback. If I’m waiting on you for more than 14 days, the timeline moves and I may schedule other work in the gap.

6. Revisions

Each deliverable includes two rounds of revisions, unless its package description says otherwise. Further rounds, or changes to an approved deliverable, are quoted before I start them.

7. Ownership

Once you’ve paid in full for a deliverable, you own the final designs, templates and copy made for you. I keep ownership of my own tools, code snippets, frameworks and know-how that existed before your project, and you get a permanent license to use them as part of your deliverables. I may show your finished work in my portfolio unless you ask me not to in writing.

8. Third-party tools

Your Klaviyo, Shopify, hosting, app and font subscriptions are yours to pay and stay in your name. I’m not responsible for outages, price changes or policy changes on those platforms.

9. Results

I build to the standard I’ve been held to in-house, but I can’t guarantee specific revenue, open rates or conversion numbers. Those depend on your product, list, offers and traffic.

10. Liability

My total liability for any claim is limited to the fees you paid me in the 3 months before the claim. Neither of us is liable for indirect or lost-profit damages.

11. Confidentiality

I keep your account data, customer lists, sales numbers and plans confidential and use them only to do your work.

12. Governing law

These terms are governed by the laws of the State of California.

13. Changes and contact

I may update these terms. Changes apply to purchases made after the update date; active subscriptions get 30 days’ email notice. Questions: josh@joshthedesigner.com.
